Should a Tourist Rental Licence Determine Your Seafront Property Purchase?

Why location and property quality matter more than an authorisation exposed to regulatory change

A valid tourist-rental licence may be attractive, but buying a Spanish seafront property solely because it has this authorisation is risky.

The licence permits a particular activity under the current rules. It does not make the property immune to changes in regional legislation, municipal planning or owners’ association decisions.

Private ownership is not an unlimited right

Article 33 of the Spanish Constitution recognises private property, but also states that its social function determines its legal limits.

The inviolability of the home appears in Article 18.2. It protects against unauthorised entry or searches, but does not prevent an economic activity inside a home from being regulated.

Ownership does not create an unconditional right to operate tourist accommodation.

Spain’s Constitutional Court has already ruled

Catalan Decree-Law 3/2023 subjected tourist accommodation in certain municipalities to prior, limited and temporary planning permission.

Constitutional Court Judgment 64/2025 rejected the challenge against this system. The Court considered that regulating tourist use did not remove ownership or prevent other uses of the property.

Could the rules change after 2027?

Yes. A future government may liberalise, maintain or tighten the rules. However, no one can currently guarantee that licences will disappear or be granted automatically after the 2027 elections.

Why buying only for the licence is risky

  • The authorisation may be temporary.
  • Renewal may depend on municipal planning.
  • The owners’ association may restrict the activity.
  • Technical and tax requirements may change.
  • A licence does not guarantee profitable occupancy.

The seafront location is the lasting asset

A licence belongs to an administrative framework. Genuine seafront views, direct access, orientation, terrace and location belong to the property itself.

The essential question is whether the home would still be a good purchase if tourist rentals became temporarily unavailable.

Treat the licence as an advantage, not the only reason to buy

  1. Verify the genuine seafront location.
  2. Assess price and building condition.
  3. Consider national and international resale demand.
  4. Review alternative personal and rental uses.
  5. Verify the licence, duration and conditions.

Buy a good property first

A tourist licence can add value, but it cannot compensate for a poor location, problematic building or excessive price.

Choose a genuine seafront property that makes sense on its own. A valid licence should be considered an additional benefit, never a permanent guarantee.
